2015 Local sex offender information

This information is available, in accordance with state law, to keep you and your family informed of convicted sex offenders living in and around our community. Included are level 3 sex offenders in the communities of Ft. Plain, Canajoharie, St. Johnsville, and Palatine Bridge.

The Sex Offender Registration Act, New York's version of Megan's Law, was signed in July 1995 and became effective on January 21, 1996. The text of the statute is contained in Correction Law Article 6-C (Section 168 et seq.).

For how long must an offender register?

  • Sex offenders who have been designated a sexual predator, a sexually violent offender or a predicate sex offender or who are classified as a Level 2 or 3 risk remain on the Sex Offender Registry for life. Level 1 sex offenders with no designation must register for a period of twenty years.

What happens if an offender fails to register?

  • The failure to register is a crime. A first conviction is punishable as a class E felony; a repeat conviction is punishable as a class D felony.

How much information can be disseminated about an offender?

The amount of information depends on the risk level and means of dissemination.

  • If the risk level is pending, you will be advised that the individual is registered as a sex offender and the risk level is pending. No additional information will be provided.
  • If the risk level is 1 or 2, you will be able to obtain much more information regarding the sex offender including the offense description, modus operandi, any special conditions imposed by the court or supervision authorities and the approximate address based on the offender's zip code.
  • If the risk level is 3, you will be able to obtain the same information for Level 1 and Level 2 sex offenders as described above plus the exact address.

Can a registered sex offender be near or on school grounds or a child care facility?

  • The New York State Sex Offender Registration Act does not restrict where a registered sex offender may live or travel. However, there are other New York State laws that may apply if the registered sex offender is still under sentence.

How can one learn if a person is listed in the Sex Offender Registry (SORA)?

  • SORA has four distinct procedures for community notification.
  • Local law enforcement agencies are notified whenever a sex offender moves into their jurisdiction. That agency may notify schools and other "entities with vulnerable populations" about the presence of offenders if the offender poses a threat to public safety.
  • 1-800–262-3257 to inquire about individuals in the Registry.
  • NYS DCJS distributes the directory to law enforcement agencies throughout the state. Citizens can review the directory at local law enforcement agencies. The list includes information on Level 2 and Level 3 offenders.
  • The directory may be accessed via the Internet, at the Division of Criminal Justice Services' website: www.criminaljustice.state.ny.us
